This policy establishes the guidelines for the collection, use, disclosure, storage, and deletion of personal data, in accordance with Law 1581 of 2012 and Decree 1377 of 2013 of the Republic of Colombia.

Scope: This policy applies to all personal information held by the Foundation, including information relating to donors, beneficiaries, caregivers, volunteers, partners, employees, and visitors to websites operated under the UNIDOS PARA SONREÍR domain.
The Foundation shall comply with the principles of legality, purpose limitation, freedom of consent, accuracy and data quality, transparency, restricted access and circulation, security, and confidentiality in the processing of personal data.

To process payments and donations, comply with contractual and regulatory obligations, including reports, audits, and issuance of donation certificates, and protect and enforce the Foundation’s legal rights.
The Foundation is committed to making information regarding its programs and operations publicly available in order to promote transparency and public trust, subject to the following limitations concerning the disclosure of confidential information:

Protection: The Foundation implements technological standards and operational security measures, including encryption, to protect personal data against loss, misuse, unauthorized access, disclosure, alteration, or destruction.
Transfer: Personal information is not sold. Information may only be shared with authorized partners, agents, or service providers acting as data processors, such as marketing service providers, who shall be contractually obligated through confidentiality agreements to protect the information and use it exclusively for the purposes established by the Foundation.
If the data subject is under sixteen (16) years of age, the Foundation requires authorization for the processing of personal data to be granted by the child’s parents or legal guardian.
