The Foundation is committed to making information regarding its programs and operations publicly available in order to promote transparency and public trust, subject to the following limitations concerning the disclosure of confidential information:

Information received from third parties under a confidentiality agreement.
Information whose disclosure could endanger an individual’s safety, violate their rights, or infringe upon their privacy, including sensitive personal information.
Information that could compromise the security or proper execution of the Foundation’s operations.
Commercial information whose disclosure could adversely affect the organization’s financial interests.

Transfer: Personal information is not sold. 23. POLICY AND INFORMED CONSENT FOR SPORTING EVENTS

Participation Policy

Participation in sporting events organized by Fundación Unidos Para Sonreír is subject to the following age requirements:

Young people between twelve (12) and fourteen (14) years of age may participate only in the 3-kilometer (3K) distance.
Young people over fourteen (14) and up to eighteen (18) years of age may participate in either the 3K or 5K distance.
All participants under eighteen (18) years of age must be accompanied by an authorized adult or responsible third party.
Participants’ ages will be verified through a valid identification document.

Paragraph: Children under twelve (12) years of age may not participate in any of the available distances.

Physical Condition

By purchasing a ticket through our authorized channels, the participant and/or their legal representative irrevocably declares that the participant is in good health and in adequate physical and mental condition to participate in the sporting activity and does not have any pre-existing medical condition or injury that could be aggravated by physical exercise.

Assumption of Risk

Participation in this activity involves inherent risks, including but not limited to falls, bruises, muscle injuries, dehydration, accidents caused by third parties, or conditions associated with the event route.

By purchasing the ticket, the participant and/or their legal representative acknowledges and assumes all such risks.

Informed Consent and Release of Liability

By purchasing the ticket, I agree, on my own behalf and on behalf of the participant, to the following:

I expressly release Fundación Unidos Para Sonreír, its directors, employees, volunteers, agents, and sponsors (the “Organizers”) from liability for any claim, demand, compensation, injury, damage, loss, harm, accident, or death that the participant may suffer or cause to third parties as a direct or indirect result of the inherent risks associated with participating in the race.
I irrevocably waive, to the fullest extent permitted by applicable law, any legal or judicial action against the Organizers arising from the circumstances described above. This waiver shall not apply to cases involving willful misconduct, gross negligence, or other forms of liability that cannot legally be waived under applicable law.
I assume full responsibility for any damage caused by the participant to third parties or property during the event.
I authorize the Organizers and medical personnel to request and/or provide medical assistance, including first aid and transportation to a medical facility when necessary. I assume responsibility for any medical treatment and transportation costs not covered by the event insurance or the participant’s social security or health insurance.
I authorize the Organizers to use the participant’s name, voice, and image, including photographs and videos recorded during the event, for promotional, advertising, educational, and informational purposes without compensation.
I certify that I have read this Consent and Release in its entirety, fully understand its contents, and voluntarily accept its terms by purchasing the ticket.

UNIDOS PARA SONREÍR accepts no responsibility for the conduct of users who fail to comply with these publicly available terms and conditions.

AUTHORIZED AGENTS

We may share your information with selected agents or service providers, including external contractors and partners who assist in maintaining our websites, solely for the purpose of enabling us to perform our work.
